Who are we?

Pursuant to the Personal Data Protection Act B.E. 2562 (2019) (the “PDPA”) Data Controller means YGMM Co., Ltd. located at No. 50, Sukhumvit 21 Road (Asoke), Klong Toey Nuea Sub-district, Wattana District, Bangkok 10110.

Website Members means persons who have signed up to be members of our website to receives our information, news and activities.

Online Audition Applicants means persons who have already been the Website, Facebook YGMMOFFICIAL and Line Official @ygmm_audition Members and are applying for an online audition for a place as artist trainee under our label.

Online Audition Application Process

To arrive at the mutual understanding, we set out below three (3) steps of our online audition application process.

• Each applicant will be preliminarily screened through their qualifications, abilities and suitability based on the information provided onto the online audition recruitment system (Recruitment). (Website or Line Official @ygmm_audition)
• Selected applicants will be asked to join an interview session and audition screen test to display their abilities and talents (Interview & Audition).
• Successful applicants will be accepted as new artist trainees under our label (Admission).

We may receive your personal data through the online audition process as follows.

What type of personal data are we collecting?

When you have signed up to be our website’s member, we will collect your general personal data consisting of:

• Given Name – Family Name
• Gender
• Age
• Email
• Country of Origin

As for the online audition, we will use your data provided through the online audition system through http://www.ygmmofficial.com. Facebook YGMMOFFICIAL and Line Official @ygmm_audition in support of the interview session. In this regard, we will collect your general personal data consisting of:

• Given Name – Family Name
• Nickname
• Thai National Identification Number or Passport Number
• Photograph
• Gender
• Age
• Date of Birth
• Body Height and Weight
• Nationality
• Educational Institution
• Address, Phone Number, Email, Social Media Account ID (Instagram, Facebook, YouTube or Tiktok)
• Special Abilities or Skills (if any)

However, we will NOT collect or request any sensitive personal data during the Recruitment or Interview & Audition processes. We will not collect your sensitive personal data, including racial, ethnic origin, political opinions, sexual behavior, religious beliefs, criminal records, health data, trade union information, etc. In the course of the Recruitment or the Interview & Audition processes, your sensitive personal data will not be considered for our artist trainee selection process in any manner..

Upon the ***Admission*** process, we will collect personal data of each selected applicant, and may consider requesting an original or photocopy of various documents, e.g., graduation certificate, diploma, commemorative honor certificate, birth certificate, certificate of name or family name change or any other documents relevant to the application which we may consider requesting as we see appropriate before we accept you as our artist trainee.

***For purpose of our running the Admission process, if you do not agree to give general personal data as
required by us, your chance of getting accepted as our artist trainee may be negatively affected.***

Objectives in Data Processing

We collect your personal data for the following purposes.

• For the purposes of the online audition processes (Recruitment and Interview & Audition), we may need to use or disclose your personal data submitted to the system, including:
  • Using given name, family name, nickname, address, phone number and email for contacting and communicating between you and us for the Interview & Audition process for us to consider selecting an artist trainee in the field you are interested in.
  • Using photograph, body weight and height as well as special abilities and skills in support of our consideration to select artist trainees based on abilities and skills (vocal, dance or rap) in the field you are interested in applying for.
  • Disclosing name, family name, nickname, photograph, address, phone number, email, Social Media Account ID (Instagram, Facebook, YouTube or Tiktok) as well as educational institution, special abilities and skills (if any) to the parties relevant to our artist trainee selection process, e.g., YG’s casting team.
• For the purposes of the Admission process, we need to use or disclose your personal data as follows.
  • Disclosing your personal data to our executive staff members for their consideration.

How do we process your personal data?

When we have received your personal data, we will take the following actions with respect to your personal data.

• We will encrypt your personal data and save onto Amazon Cloud Database which is equipped with the proper measures to safeguard your personal data and prevent unauthorized access (access control).
• We store your sensitive personal data strictly confidential and shall not disclose to any person, except for preventing or suppressing a danger to life, body or health or any other cases prescribed by Section 26 of the PDPA.
• We will keep your personal data confidential and not disclose to any other person, unless necessary, and in this regard, we shall disclose your personal data only in the event deemed necessary, proportionate and in compliance with the applicable law, including:
  • Insurance companies in case where we obtain an insurance for our artist trainees
  • Payment service providers in case where we pay any remuneration
  • Revenue Department in case where we make clarification about revenue for the purpose of withholding taxes
  • Any other governmental authorities, including Ministry of Labor in case where we are required to comply with labor protection regulations, social security affairs or labor relations regulations, Ministry of Public Health in case where we are required to comply with public health regulations, Department of Disease Control or the court of justice where we are required to comply with a court’s order or summon, etc.

In addition, we may be required to deliver your personal data to a credit bureau agency for verification purposes and use the result obtained to prevent any wrongdoings.

We may be required to transmit your personal data to organizations outside Thailand, including YG Entertainment Inc. or any other international organizations only to the extent relevant to our businesses and shall have adequate data protection standard (appropriate safeguard) whilst you are entitled to exercise rights as a data subject and exhaust the remedies available either at law or under our policies, whichever is better.

However, we may need to share personal data of all applicants to the parties involved in the YGMM Audition Project set up in cooperation between GMM Grammy Public Company Limited and YG Entertainment Inc. for their processes of consideration, selection and any undertakings related to the YGMM Audition Project to the extent necessary.

How do we store your personal data and how long do we store your personal data?

We store your personal data under the following procedures.

• Storage Characteristics

  We will encrypt your personal data and store the encrypted personal data on the Amazon Cloud Database immediately. Our database system is equipped with the unauthorized access prevention system with adequate data protection measures.

• The date storage venue is AWS Cloud whose facilities are located in Singapore.
• Storage Period

  We will store your personal data for the period deemed appropriate and necessary subject to the applicable provisions of law, the details of which are as follows.

  • As for unsuccessful applicants, we will store your personal data for three (3) years from the date on which the Recruitment and Interview & Audition processes are completed, as a proof that we have made due and fair consideration in selecting the applicants suitable for our artist trainee program.
  • As for unsuccessful applicants whose personal data, as we consider, are still relevant that we may reinvite for the Recruitment and/or Interview & Audition processes in the future, we will inform you in advance and ask for your prior consent where we will store your personal data for three (3) from the date on which we have obtained your consent.
  • As for successful applicants, we will store your personal data for as long as the term of your artist trainee contract and upon the termination of the contract for any reason, we will store your personal data for another 10 years for verification and examination purposes in case where any claim may arise within the statute of limitation prescribed by the law.
• Upon the lapse of the storage period(s) for your personal data as mentioned above or when we no longer have a proper legal ground to continue processing your personal data, we shall destruct your personal data by means of erasure or anonymization of such data within 30 days from the terminal point of the storage and processing period.

Rights of Data Subjects

You have the rights to request an action(s) upon your personal data in the following cases.

1. Right to Withdraw Your Consent

   You have the right to withdraw your consent previously granted to us for the processing of your personal data at any time for the personal data given for the Recruitment and Interview & Audition processes. However, if the applicant has passed the Admission process (i.e. having been accepted as our artist trainee) you will not be able to withdraw your consent because we are required to collect and process your personal data based on the contractual relationship we have with you.

   You have the right to request us to rectify any inaccuracy about your personal data or make any addition to incomplete personal data.

4. Right to Get Your Personal Data Erased

   You have the right to request us to erase your personal data under limited circumstances, i.e., the data collected and processed for the Recruitment and Interview & Audition only.

5. Right to Restrict the Processing of Your Personal Data

   You have the right to restrict our processing of your personal data under limited circumstances, i.e., the data collected and processed for the Recruitment and Interview & Audition only.

6. Right to Request a Transmission of Your Personal Data to a Third Party (Data Portability)

   You have the right to request us to transmit your personal data to a third-party data controller under limited circumstances, i.e., the data collected and processed for the Recruitment and Interview & Audition only (however, we reserve our rights to reject your request to exercise this right as we see appropriate).

7. Right to Object the Processing of Your Personal Data

   You have the right to object our processing of your personal data under limited circumstances, i.e., the data collected and processed for the Recruitment and Interview & Audition only.
